Gerry Lukaniuk’s Story
   Greenwood resident Gerry Lukaniuk strongly believes the city wronged him and he is actively seeking to have the matter corrected. “I was reading in the paper what I cost the city so far. Actually it is the city’s stupidity that has cost the citizens $20,000.”
   Mr. Lukaniuk states that all the land dealings he entered into with the City of Greenwood were allowed and were done as outlined under the community charter. “That is a given,” Mr. Lukaniuk says. “A deposit was made within the agreed upon time frame. We made a deal. They reneged, and now they are going to have to deal with the ramifications.”
   Mr. Lukaniuk’s legal counsel has stated, “Under the basic foundation of the law of contract, you cannot enter into a valid agreement and then arbitrarily revoke that agreement after there has been an offer, acceptance and consideration. Once an offer has been embarked on, it is too late to revoke.”
   “In December of ‘05 they overturned the previous council’s decision to sell me the land”, says Mr. Lukaniuk.  “There are five excuses the city puts up as to why they couldn’t sell the land. They won’t stand up in court.”
   “My litigation against the city is based on facts, law and the community charter. We entered into a legally binding agreement.”
   He further adds, “After I made the agreement of purchase on that property, I entered into an agreement with a group from Kelowna to purchase a portion of it off me once I had finished developing it. My loss on that sale alone is $75,000. The judge will determine what is fair in this matter.”
   This issue has been proceeding through the court registry in Rossland since autumn and appears like it will end with a trial in April, 2007.

Recently, Alberta Premier Rachel Notley said, “Democratically elected people should not be confronted with threats of being jailed.”

That is wrong, Ms. Notley. Anyone who commits a crime should be confronted with jail if the crime warrants it.

You don’t get a free pass because you are democratically elected. You don’t get special privilege.

The Canadian Charter starts off with the words: “Whereas Canada is founded upon principles that recognize the supremacy of God and the rule of law.”

Democratically elected officials are not above that no matter how much they think they are. If they commit a crime, the public has every right to sing out loudly “lock ‘er up!”
